Please read these Terms and Conditions carefully before using the Eldercairn website or registering for any of our educational sessions. By accessing this website or participating in a session, you confirm that you have read and understood these terms.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

  • "Eldercairn", "we", "us", "our" — refers to the educational workshop organisation operating under the name Eldercairn, based at 128 Charoen Prathet Road, Chang Khlan, Chiang Mai 50100, Thailand.
  • "Website" — the website published at eldercairn.blog and all pages and content within it.
  • "Services" — the educational sessions, information workshops, and associated reading materials provided by Eldercairn.
  • "Participant" / "User" / "You" — any individual or organisational representative who accesses the Website or registers for, attends, or otherwise engages with our Services.
  • "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy, which together form the full agreement between you and Eldercairn.
  • "Content" — all text, materials, handouts, presentation slides, checklists, templates, and reference packs produced or distributed by Eldercairn.
  • "Session" — any individual workshop, seminar, or group programme delivered in person or in a hybrid format by Eldercairn.

2. Acceptance of Terms

By visiting the Website or by completing a registration enquiry or enrolment for a Session, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Website or participate in our Services.

You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are registering on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

Use of this Website is voluntary. Nothing on this Website constitutes an obligation to purchase or register for any Session.

3. Service Description

Eldercairn provides educational and informational group sessions on the following topics:

  • Retirement-System Orientation Seminar — a plain-language group session covering general information about national and workplace retirement structures in Thailand, common document types, and sources of publicly available official information. This session is educational in nature and does not constitute advice on any individual's personal situation.
  • Document Organisation Workshop — a practical, administrative session focused on gathering, labelling, and storing personal records in an organised way. This session does not address individual case outcomes or legal entitlements.
  • Group Information Programme for Employers — a multi-session educational programme supporting HR teams in communicating general retirement-benefit information to their employees. This programme addresses communication processes only, not individual entitlement decisions.

All sessions are delivered in the English language and are held in Chiang Mai, Thailand, unless otherwise agreed in writing. Eldercairn reserves the right to change session dates, venues, or formats with reasonable notice.

Eldercairn does not offer regulated financial advice, legal advice, or any service that constitutes professional advice under Thai law or any other jurisdiction.

4. User Responsibilities

When using the Website or participating in a Session, you agree to:

  • Provide accurate and complete information when submitting enquiries or completing registration.
  • Treat session facilitators and other participants with courtesy and respect.
  • Refrain from recording any session (audio, video, or otherwise) without prior written consent from Eldercairn.
  • Not reproduce, redistribute, or sell session materials, handouts, or Content without written permission.
  • Use the Website and its Content for personal, non-commercial reference only, unless a separate written arrangement has been made.
  • Not attempt to gain unauthorised access to any part of the Website or its underlying systems.
  • Not upload, transmit, or distribute any harmful, misleading, or unlawful content through any communication channel linked to the Website.

Eldercairn reserves the right to refuse participation to any individual whose conduct is disruptive or whose use of materials falls outside these terms.

5. Enrolment & Attendance

Registration for a Session is completed by submitting an enquiry through the Website contact form or by corresponding with us directly. A Session place is confirmed only upon receipt of full payment and written acknowledgement from Eldercairn.

Participants are expected to attend the Session on the confirmed date. If you are unable to attend, please notify us as early as possible so that your place may be reallocated. See Section 6 for the refund and cancellation policy.

For group or employer programmes, a minimum participant number may apply. Eldercairn will confirm this at the point of enrolment. If a minimum is not reached, Eldercairn may reschedule the Session and will notify registered participants promptly.

6. Payment & Refunds

Pricing

Session fees are quoted in Thai Baht (฿) and include all session materials unless otherwise stated. Applicable taxes are included in the displayed price. Prices are subject to change without prior notice, but any change will not affect confirmed bookings for which payment has already been received.

Payment

Payment methods and instructions will be provided upon confirmation of your registration. Payment is due in full prior to the Session date. Participation may be withheld if payment has not been received by the agreed date.

Cancellation by Participant

  • Cancellations made more than 14 days before the Session date: a full refund, less any applicable bank transfer charges, will be issued.
  • Cancellations made 8–14 days before the Session date: a 50% refund of the session fee will be issued.
  • Cancellations made 7 days or fewer before the Session date: no refund will be issued. You may, however, request a credit towards a future session, subject to availability.

Cancellation by Eldercairn

If Eldercairn cancels a Session for any reason, all participants will receive a full refund of the session fee paid, or the option to transfer their registration to an alternative date. Eldercairn is not liable for any additional costs incurred by participants as a result of a cancellation, including travel or accommodation expenses.

7. Intellectual Property

All Content produced by Eldercairn — including session materials, handouts, checklists, folder templates, reference packs, presentation slides, and website text — remains the intellectual property of Eldercairn and is subject to copyright protection under applicable Thai law.

Upon participation in a Session, you are granted a limited, personal, non-transferable licence to use the session materials provided to you for your own reference purposes. This licence does not permit you to:

  • Copy or reproduce materials in bulk for distribution to others.
  • Sell, license, or commercially exploit any Content.
  • Remove or alter any copyright notices, attributions, or branding from materials.
  • Adapt or build upon Content without prior written consent from Eldercairn.

For organisations enrolling in the Group Information Programme for Employers, presentation materials provided for internal reuse may be used within your organisation for the purposes described at the time of enrolment. Any broader use requires written agreement.

8. Disclaimers

All content provided by Eldercairn — whether on the Website or in a Session — is for general informational and educational purposes only. It does not constitute financial, legal, tax, or any other form of professional advice, and should not be relied upon as such.

Eldercairn does not represent or suggest that attendance at a Session will lead to any particular personal, professional, or financial outcome. Every individual's circumstances differ, and participants are encouraged to seek appropriate professional counsel for their own situation.

The Website and its Content are provided on an "as available" basis. Eldercairn makes reasonable efforts to keep information accurate and current, but does not represent that all information is free from error or that it reflects the most recent changes to relevant laws or policies.

Links to external websites or official sources are provided for convenience only. Eldercairn has no control over the content of those sites and accepts no responsibility for their accuracy or availability.

9. Limitation of Liability

To the fullest extent permitted under applicable Thai law, Eldercairn and its facilitators shall not be liable for any indirect, incidental, or consequential loss or damage arising from:

  • Reliance on any information or Content provided through the Website or in a Session.
  • Inability to access or use the Website for any reason.
  • Any error or omission in session materials or website content.
  • Loss of data or information.

Where liability cannot be fully excluded under applicable law, Eldercairn's total liability to you in respect of any single claim shall not exceed the amount paid by you for the Session to which that claim relates.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold harmless Eldercairn and its facilitators from and against any claims, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms and Conditions.
  • Your misuse of any Content or materials provided in connection with a Session.
  • Any false or misleading information provided by you in connection with a registration.

11. Cancellation & Termination

Either party may withdraw from a confirmed Session booking subject to the cancellation terms set out in Section 6.

Eldercairn reserves the right to refuse or withdraw access to the Website or any Session at any time and without prior notice where it has reason to believe these Terms have been breached or that continued participation would be harmful to other participants or facilitators.

If your access is withdrawn due to a breach of these Terms, you will not be entitled to a refund of any fees paid.

Clauses relating to intellectual property (Section 7), disclaimers (Section 8), limitation of liability (Section 9), and dispute resolution (Section 12) continue to apply after any termination or cancellation.

12. Dispute Resolution

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising in connection with these Terms, the Website, or a Session will be subject to the jurisdiction of the courts of Thailand.

Before initiating any formal process, both parties agree to make reasonable good-faith efforts to resolve any disagreement through direct communication. If you have a concern about any aspect of our Services, please contact us at [email protected] and we will respond within a reasonable time.

Where a dispute cannot be resolved informally, the parties may agree to refer the matter to a mutually acceptable mediator before pursuing other remedies.

13. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Eldercairn regarding your use of the Website and participation in Sessions, and supersede any prior understandings or representations.

Severability. If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

Waiver. Eldercairn's failure to enforce any provision of these Terms on a particular occasion does not constitute a waiver of that provision on any future occasion.

Assignment. You may not assign or transfer your rights under these Terms without Eldercairn's prior written consent. Eldercairn may assign its rights and obligations under these Terms in the context of a reorganisation or transfer of its activities.

14. Changes to These Terms

Eldercairn may update these Terms and Conditions from time to time to reflect changes to our Services, legal requirements, or operational practices. When we do, the revised terms will be published on this page with an updated "Last updated" date.

For significant changes, we will make reasonable efforts to notify registered participants via email. Continued use of the Website or participation in a Session following the publication of revised terms constitutes acceptance of those terms.
